Terms & Conditions

PAYMENT TERMS: CalOptix standard payment terms are net 30 days from invoice date. A late charge shall be applied at the rate of 1-1/2% per month on all past due account balances. Past due balances negate the entitlement of any discounts and will cause interruption of services. All prices are based on our current price list, and are subject to change without notice. Orders are accepted subject to prices in effect at the time of shipment. Shipments are F.O.B. Hayward, California. In the absence of specific shipping instructions, shipments will be made in the most practical manner.

TITLE: Title to the merchandise covered by this contract shall not pass to the buyer until the invoice is paid in full.

CONTRARY TERMS: These terms and conditions of sale supersede any terms and conditions appearing on the buyer’s purchase order or other documents, and all verbal communications and/or understandings. Unless specifically provided herein, no other terms or conditions shall apply. The provisions of the Commercial Code as adopted in California shall govern circumstances not provided for herein. This contract is subject to and governed by the laws of the Sate of California.

ATTORNEY’S FEES: Buyer shall be responsible for all reasonable expenses, costs and attorney’s fees incurred to collect monies owed hereunder.
